Terms of Service
Last updated: September 23, 2026
These terms govern your use of the Nestory app for iPhone, iPad and Apple Watch (the “App”). By downloading, opening or using the App, or by making a purchase in it, you agree to these terms and to the applicable Apple terms. If you do not agree, please do not use the App.
1. Who we are and how these terms fit together
“Nestory”, “we”, “us” and “our” mean the app provider identified as the seller or developer on the App Store product page. “You” means the person who downloaded, uses, or made a purchase in the App.
The App is licensed to you, not sold. Apple’s Licensed Application End User License Agreement and the Apple Media Services Terms and Conditions also apply to your license. These Nestory terms add to them on the App’s services, content, privacy, free tier, App Store introductory offers and paid access. Where mandatory law or Apple’s terms conflict with these terms, whichever has priority prevails.
2. Who may use the App
Nestory is intended for adults: people who are pregnant or trying to conceive, parents, legal guardians and adult caregivers. You must be able to enter into a binding agreement under the law of the country where you live.
When you enter or share information about a child, a partner or anyone else, you are responsible for having the legal right and any consent needed to use that information. The App is not designed for children to use on their own.
3. What Nestory does
Nestory is a personal companion for cycle tracking and trying to conceive, pregnancy, postpartum recovery, neonatal intensive care, baby care, family organisation and health notes. It may include tracking logs, calendars, estimates, reminders, checklists, reports, an Apple Health connection, Apple Watch, Live Activities, Home Screen widgets, Siri shortcuts, iCloud sync and invitation-only family sharing.
Some features vary by device, operating-system version, country or region, Apple services, internet connection, permissions, subscription status or App Store availability.
4. Not a medical service
Nestory is a general health and wellness information tool. It is not a medical device, a diagnostic system, medical advice, treatment or emergency care, and it does not replace any of them. Cycle and fertility estimates, due-date calculations, fetal size comparisons, movement patterns, contraction timing, blood-pressure ranges, glucose interpretations, mood and perimenopause self-assessments, growth charts, vaccine reminders and other guidance are not medical conclusions about your situation.
If you have questions about symptoms, your pregnancy, your mood, your child’s health or medication, talk to your doctor, midwife, paediatrician or another qualified professional. Never delay seeking professional care because of something the App shows.
In an emergency — if there is a risk of harm to you or someone else, if fetal movement has noticeably decreased, or if you have heavy bleeding, severe pain, difficulty breathing or other serious symptoms — contact your local emergency number or a hospital directly instead of relying on the App.
5. Estimates and accuracy
The App’s estimates, charts, guidance and reminders rely on the information you enter, your device’s clock, the guideline set you chose, statistical models, third-party calculation references and general reference material. If information is missing or wrong, or sync is delayed, results can change.
You are responsible for checking what you enter, confirming medical decisions with a professional, and not relying on the App as the only reminder for medication or treatment.
6. Accounts, device data and sync
Nestory does not require an account or login for its core features. Your data is stored on your device. In the current version, iCloud sync is on by default and can sync your data to your own devices through your Apple Account; you can turn it off in the App’s Settings.
iCloud, HealthKit, notifications, photos, family sharing and other Apple services each have their own system permissions, Apple Account requirements and Apple terms. You can change your permissions at any time, but withdrawing a permission does not automatically delete data that was already stored.
How data is handled is described in the Nestory Privacy Policy.
7. Family sharing and other people’s data
Family sharing uses Apple CloudKit’s invitation-only sharing. The owner of a shared space invites a specific Apple Account, and once the invited participant accepts they can view and, where permitted, edit the shared profiles, logs, checklists, notes, tasks and plan information.
You are responsible for inviting the right person, reviewing what you share and removing access when a relationship changes. Nestory cannot control what an invited person does, including screenshots they take, files they export or copies they keep outside the App. Product rules keep a mother’s personal medical history and her own medication and supplement records out of the shared space, while shared pregnancy logs such as fetal movement and contractions can be visible to participants. Check the exact scope in each version of the App.
8. The free tier and the App Store introductory offer
Nestory’s core features can be used without a subscription, without a time limit and without payment details. They include logging fetal movement, contractions, cycle days, feeds, sleep, diapers and vitals; safety guidance and screenings; a brief guide for the current week or month; and viewing, exporting and deleting your own data. Deeper features — history, trends, charts and insights, the full guides, Apple Watch, Live Activities, the Home Screen widget, family sharing, clinical reports, multiple children and unlimited memories — are unlocked by a Nestory Premium subscription.
The set of features included in the free tier may change over time; material changes are announced under section 15. Safety features — fetal movement and contraction logging, urgent guidance, screening results, emergency contacts and access to your own data — stay available even after a subscription ends.
App Store introductory offer: when Apple determines that your Apple Account is eligible, the 1 Year plan shows a free trial of one month. If you start it, a paid subscription begins automatically when the trial ends, on the terms the App Store showed you, and renews until cancelled. Eligibility, the trial length and the following charge are confirmed by the App Store before you confirm the purchase. If you do not wish to continue, cancel at least 24 hours before the trial ends.
An earlier in-app exploration period that is no longer offered remains available, until it ends, to anyone who started it before it was withdrawn.
9. Subscriptions
Nestory Premium is an auto-renewing subscription available as monthly, six-month and yearly plans. Every plan unlocks the same Premium features; only the length and the price differ. Availability, the local price, currency, tax, any trial period and the billing cycle are shown by the App Store before you confirm a purchase, and that information is final.
An auto-renewing subscription renews at the end of each billing period until it is cancelled. Apple charges the payment method linked to your Apple Account. Price changes, tax, renewals and any consent requirements follow Apple’s rules and the law of your country.
One active plan also covers the participants you have invited through family sharing, for as long as the invitation stands. Invited participants cannot buy a separate plan for someone else’s shared data.
The Lifetime and Founder Lifetime one-time purchases were withdrawn on 30 July 2026. Anyone who bought one before that date keeps that access.
10. Restoring purchases, cancelling and refunds
Purchases are made through StoreKit and the App Store. You can restore your access with the “Restore Purchases” action in the App. Manage or cancel a subscription in the Settings app on your iPhone or iPad under your Apple Account → Subscriptions. Deleting the App does not cancel a subscription.
Refunds are decided by Apple. You can request a refund for an eligible purchase at reportaproblem.apple.com. Because Nestory does not hold your payment details, it cannot issue App Store refunds directly. Rights given to you by the mandatory consumer-protection law of your country are not affected.
11. License and acceptable use
For as long as you comply with these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes on Apple devices you own or control.
You must not:
- extract source code, reverse-engineer, decompile or modify the App, except where mandatory law allows it;
- copy, sell, rent or sublicense the App, the license, its content or your access rights;
- circumvent, tamper with or misrepresent purchases, access rights, App Attest, security, rate limits or access controls;
- use the App to violate other people’s rights, privacy or intellectual property, or to break the law;
- run automated attacks, malware or excessive load against the service, its backend, CloudKit shares or other users.
12. Your content and backups
The journal entries, photos, notes, profiles and logs you enter remain yours. You allow Nestory and Apple the technical processing needed to run the App, sync, create reports and export files, and share with the participants you invite.
You are responsible for having the right to enter, store and share your content, and for not infringing third-party copyright, privacy or other people’s sensitive information. We recommend keeping your own copies of important reports, photos and backups in a safe place. Sync is not a complete substitute for a backup.
13. Intellectual property
The Nestory software, source code, design system, artwork, text, the selection of health content, trademarks, logos and other materials belong to Nestory or its licensors and are protected by copyright, trademark and other intellectual-property laws. All rights not expressly granted here are reserved.
If you send us voluntary feedback, we protect your personal data under the Privacy Policy and may use the idea to improve the product without owing payment or ownership.
14. Third-party and Apple services
The App may rely on third-party services such as the Apple App Store, StoreKit, iCloud, CloudKit, HealthKit, Maps, Photos, notifications, MetricKit, App Attest and contracted cloud-infrastructure and data-processing services. Those services have their own terms, privacy practices, availability and regional limits.
We do not fully control third-party outages, Apple Account settings, network failures, operating-system changes or App Store decisions. That does not release us from our own obligations for the integrations we operate, for data protection, or for your statutory consumer rights.
15. Updates, changes and availability
We may add, change or remove features, and raise the minimum supported operating-system version, for security, legal, Apple-platform, product or technical reasons. If we change a paid feature materially, we will give reasonable advance notice and follow mandatory law and App Store requirements.
We may need to suspend the App or withdraw it from the App Store. In that case we will handle access rights, data export, notice and legal remedies fairly and as far as possible.
16. Warranties and limitation of liability
To the maximum extent permitted by mandatory law, the App is provided “as is” and “as available”. We do not warrant that the App will be uninterrupted or error-free, compatible with every device, that every estimate is accurate, or that it suits your specific medical situation.
To the maximum extent permitted by mandatory law, Nestory is not liable for indirect, special, incidental or consequential damages, lost profits, lost opportunities, reputational harm or loss of data arising from use of the App. Where monetary liability is established, our total liability is limited to the greater of the amount you paid Nestory in the 12 months before the claim or USD 50.
This section does not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, breaches of personal-data law, or any other liability that the law does not allow to be limited. Your mandatory consumer rights remain unaffected.
17. Breach and termination
You can stop using the App at any time by deleting it and cancelling any subscription separately. If you seriously or repeatedly breach these terms, create a security risk or abuse the service, or if the law requires it, we may restrict access to network-dependent features or terminate the license.
Termination does not affect payments already due, or the ownership, privacy, intellectual-property, disclaimer and dispute provisions that arose before it.
18. Changes to these terms
When we change these terms we update the “Last updated” date. Material changes that affect payment, the license, privacy, liability or your rights will be announced in the App or on this page before they take effect. Where the law allows, continuing to use the App after a change takes effect means you accept the new terms.
19. Governing law and disputes
These terms are governed by the law of the App provider’s principal place of business as registered with the App Store, without regard to conflict-of-law rules. This does not limit the mandatory consumer-protection, privacy and court-access rights of the country where you habitually live.
If a dispute arises, please contact Nestory support first; we will try to resolve it in good faith within 30 days. If that fails, you may bring the matter before a competent court or a consumer dispute body permitted by law.
20. Contact
Send questions about these terms, access unlocked by a purchase, technical problems or rights requests through the Nestory support link at the bottom of this page. App Store billing, cancellation and refund matters are handled by Apple Support or reportaproblem.apple.com.
